Eligibility

Use of AIHubBina services requires that you are legally able to form binding contracts and comply with these Terms. Services are intended for business and professional users seeking AI software integration and automation solutions in Malaysia and internationally where permitted by law.

Users must meet the minimum age required by applicable law to enter into binding contracts in their jurisdiction. Minors may not register for or use the services independently.

You must use the services in a lawful manner and in compliance with applicable regulations, including laws governing data protection, export controls, and intellectual property.

Access to AIHubBina services may be restricted in certain jurisdictions. It is your responsibility to ensure that use of the services is permitted under local laws and any applicable sanctions or export control regimes.

Account registration and responsibilities

To access certain features you may register for an account. Account registration requires accurate information and adherence to account security guidelines. Accounts are for individual or organizational use as specified during registration.

You agree to provide complete and accurate information when creating an account and to keep that information up to date. Inaccurate or outdated information may affect service access or support.

You are responsible for maintaining the confidentiality of account credentials and for all activities that occur under your account. Notify AIHubBina promptly if you suspect unauthorized access.

Accounts are non-transferable unless expressly agreed in writing by AIHubBina. Any attempt to assign or transfer rights may be void and subject to termination.

If you believe your account has been compromised, contact support immediately so we can take steps to secure your account and assist with remediation.

AIHubBina may suspend or restrict access to accounts for suspected breaches of these Terms, security concerns, or legal requirements. We will provide notice where practicable.

Service scope and use

AIHubBina provides consultancy, software integration, automation workflow development, and related services. Service descriptions and deliverables are set out in statements of work or service agreements. Standard offerings include system assessment, integration planning, custom connectors, and deployment support.

AIHubBina may modify, enhance, or discontinue features of the services. Where changes materially affect existing paid services, we will provide notice and any applicable transition information consistent with contractual commitments.

We strive to maintain reasonable service availability but do not offer uninterrupted access. Scheduled maintenance and upgrades may affect service availability; notifications will be provided when feasible.

Acceptable use rules

When using AIHubBina services you must comply with the following rules to ensure secure and lawful operation of integrated systems and automation:

• Do not use the services to develop, deploy, or execute unlawful activities or outputs that violate applicable laws.
• Do not attempt to probe, scan, or test the vulnerability of AIHubBina systems without explicit authorization.
• Do not upload content that infringes third-party intellectual property rights or violates privacy rights.
• Follow security best practices when integrating systems, including proper credential handling and access controls.
• Disclose known risks and limitations of integrations to end users and maintain accurate documentation of automated processes.
• Do not attempt to reverse engineer proprietary components of AIHubBina software unless permitted by law and written agreement.
• Comply with export controls and sanctions when transferring data or deploying solutions across borders.

User content and data

Users may provide content, configuration, and data as part of using the services. Such user content remains subject to these Terms and any applicable privacy commitments.

You retain ownership of data and content you upload or provide to AIHubBina, subject to the license you grant to enable service delivery and support.

By submitting content you grant AIHubBina a limited, non-exclusive license to access, use, store, and process that content as necessary to provide, maintain, and improve the services, to the extent permitted by applicable law.

You are responsible for the legality, accuracy, and reliability of user content and for obtaining any required consents from data subjects prior to providing personal data to AIHubBina.

Requests to remove user content will be handled in accordance with applicable law and contractual terms. Removal of content may affect the functioning of deployed integrations or automation.

Intellectual property

AIHubBina and its licensors retain ownership of all intellectual property rights in the services, platform, and documentation, excluding user-provided content and any components expressly licensed to you.

• Do not copy or reproduce proprietary software components except as allowed by a written license.
• Do not create derivative works from AIHubBina proprietary code without explicit permission.
• Respect third-party licenses and open-source notices provided with components used in integrations.

Paid services and billing

Certain features, professional services, and integrations are provided for a fee. Paid services are governed by these Terms and any separate service order or statement of work.

Pricing for paid services is specified in quotes, proposals, or online pricing pages. Fees are based on service scope, resources required, and any third-party costs.

Payments are due according to the invoice terms. Accepted payment methods are detailed in invoices or the customer agreement. Unpaid amounts may accrue late fees as permitted by law.

Subscription services billed on a recurring basis will renew automatically unless cancelled according to the subscription terms. Cancellation procedures and notice periods are defined in customer agreements.

Refunds for paid services are handled on a case-by-case basis and governed by the terms of the applicable agreement. Refund eligibility may depend on service type and work completed.

Customers may cancel subscriptions or professional engagements per the cancellation provisions in their service agreement. Cancellation may not affect obligations to pay outstanding fees for work already delivered.

Customers are responsible for any applicable taxes, duties, or levies associated with paid services unless otherwise specified. AIHubBina may invoice taxes in accordance with local rules.

AIHubBina may adjust prices for future billing periods with notice as required by contract. Existing fixed-price commitments remain subject to the terms of the applicable agreement.

Non-payment may result in suspension of services, restriction of access, and collection actions. AIHubBina will communicate before taking such measures when feasible.

Disclaimer

Services are provided "as is" to the extent permitted by law. Information and recommendations provided by AIHubBina are based on available data and engineering judgment; they are not a substitute for professional or legal advice tailored to specific circumstances.

Limitation of liability

To the maximum extent permitted by law, AIHubBina's liability for direct damages arising from use of the services is limited to amounts paid by the customer for the relevant services during the prior 12 months. AIHubBina is not liable for indirect, consequential, or special damages.

Third-party services

Integrations with third-party products and services may be subject to additional terms and privacy practices of those providers. AIHubBina is not responsible for third-party performance or compliance.

Termination and suspension

Either party may terminate service agreements in accordance with the termination provisions in the applicable contract. AIHubBina may immediately suspend or terminate access for violations of these Terms or illegal activity.

On termination, access to services will cease and AIHubBina may delete user data in accordance with the data retention policy and contractual terms. Customers should export required data prior to termination.

Privacy and data processing

Use of personal data is governed by the AIHubBina privacy policy. Data processing, retention, and subject rights are described in that policy and in any applicable data processing agreements.

Communications

AIHubBina may send service-related communications by email or other contact methods provided in your account. Marketing communications will be sent only with consent or where lawful interest has been assessed.

Changes to terms

AIHubBina may update these Terms. Material changes affecting service access or key obligations will be communicated in advance when practicable. Continued use after notice constitutes acceptance of the updated Terms.

Governing law

These Terms are governed by the laws applicable where AIHubBina operates, unless a different governing law is agreed in a written service agreement. Disputes will follow the dispute resolution provisions below.

Dispute resolution

Parties will attempt to resolve disputes through good faith negotiation. If unresolved, disputes may be referred to mediation or the relevant courts as specified in the service agreement.
